More importantly in court, the argument would be that when your brought the GPU you got the drivers on a CD, thats how you brought your device. In that state with them drivers.
The future of AMD is looking fairly bright, but with your loss in court and a counter claim for wasting time, the money you'll need to pay will probably still come in handy.
believe me if i had the necessary money for the court i would probibly won the trial cose this software update crimson doesnt contain beta stage and bugs that limits making GPUs stutter and working on 70% power of 100% its the serious threat to the company but all i want them to fix the problem faster on next release and never do such mastakes
You fail to understand the concept of the PC, this isnt a closed absolute system like Mac or console where everything is finite/error free. This is a system of multiple configurations, each constantly changing. A variety only limited by time.
Since the dawn of GPUs, 3DFX days some drivers on a PC system will not work, thus the only option is to roll back to the ones that did. Its been common practice for a fair amount of time due to the nature of PCs.
Again the drivers provided at point of sale are the drivers that work with your system, and again the argument would be why are you not just using them? There is no obligation to build on or improve them. The jury would laugh you out.

Clock speeds fluctuate unless you use software like Afterburner to enable unofficial OC modes, that part is 100% working as intended. The GPU clock rises and falls as dictated by the work it needs to do. If a game is not pushing your clock to its maximum, then it's either not a very demanding game or it's not particularly efficient (eg: Fallout 4).
